When you are required to go to court for a civil, criminal or penal hearing, the interpreter plays a major role.
They are the bearer of your speech, and therefore, the person who allows you to fully express yourself on issues that are important to you, whether they are financial or family related.
If the magistrate asks you to speak, you will be able to do so through the interpreter, who will translate your speech.
Throughout the hearing, you will be able to follow what is being said thanks to the interpreter, who will translate everything that is spoken by the parties, the lawyers, the magistrates and the presiding judge.
When more than two people require translation, equipment is used. Headphones will be distributed to members of the party who do not speak the language of the hearing.
The interpreter will work with a microphone to relay the proceedings to everyone.
At the start of the hearing, the presiding judge will inform the parties and lawyers that an interpreter will translate the statements of a party or witness.
This interpreter must be sworn, in order for these statements to be taken into account during the court hearing.
The interpreter’s role is to faithfully translate the statements made. The interpreter is bound by professional secrecy and, therefore, should not discuss their notes or what they have heard and translated with anyone afterwards. This is even more so the case when the hearing is held in camera, as is the case during the investigation in particular.
There are two ways of translating orally: consecutively and simultaneously. Consecutive interpretating requires the interpreter to take notes and transcribe the words as they are spoken. Simultaneous interpretating requires the interpreter to translate at the same time as they hear the speech during the hearing.
This requires equipment as soon as there are more than two people requiring this translation service. Otherwise, for a single person, the interpreter can translate through chuchotage and by speaking directly to the audience to translate into the opposite
language direction.
The interpreter does not interrupt the speech but, on the contrary, allows it to flow more smoothly. Magistrates are mindful of the quality of the interpreter who assists you as it can simplify their job and contribute to the quality of the hearing and, ultimately, of their decision.
To put together your case, your lawyer will need to gather several written documents that will need to be translated. For example, the sworn translator can help you translate a testimony, a court transcript, WhatsApp exchanges, letters, civil status documents, contracts and powers of attorney.

A sworn translation does not have the same value as a certified translation. For your marriage application, don’t make the mistake of ordering any other translation than a sworn translation completed by a translator registered at a Court of Appeal, because it will unfortunately end up costing you… twice as much!
